CONSIDERANDO:<\/strong><\/p>\nQue tienen por objeto el uso de la tierra para el desarrollo equilibrado de la comunidad y no como bien de especulaci\u00f3n del mercado;<\/p>\n
Que la Provincia del Chaco tambi\u00e9n cuenta con normas protectorias que regulan la transferencia de tierras fiscales, adjudicadas a las y los ocupantes reales;<\/p>\n
Que as\u00ed establecen en los art\u00edculos 29 inciso g) y el art\u00edculo 38 de la Ley 471 \u2013P-REGIMEN DE TIERRAS FISCALES. CREA EL INSTITUTO DE COLONIZACI\u00d3N;<\/p>\n
Que tambi\u00e9n para las tierras habitadas por comunidades ind\u00edgenas el art\u00edculo 11 de la Ley 652 \u2013W-NORMAS P\/COMUNIDADES ABOR\u00cdGENES. CREA I.D.A.CH-, directamente proh\u00edbe cualquier tipo de transacci\u00f3n sobre el inmueble, dej\u00e1ndolas fuera del mercado inmobiliario, respetando la cosmovisi\u00f3n de los pueblos originarios sobre el territorio.<\/p>\n
Que es necesario reflejar en la ordenanza la continuidad de los derechos de las familias arraigadas en la tierra fiscal y establecer en forma clara la transferencia;<\/p>\n
Que para asegurar el mejor uso de los ingresos provenientes de las adjudicaciones de las tierra fiscal, se establece un fondo especial con el producido de la venta de las tierras fiscales, denominado \u00abAcceso a tu Hogar\u201d, cuyo objetivo es financiar la producci\u00f3n de suelo urbano de uso habitacional. con el fin de implementar el inciso 4) del art\u00edculo 97 de la Carta Org\u00e1nica;<\/p>\n
EL CONCEJO MUNICIPAL DE LA CIUDAD DE RESISTENCIA<\/strong>
\nSANCIONA CON FUERZA DE ORDENANZA:<\/strong><\/p>\nArt\u00edculo 1:<\/strong> Incorp\u00f3rese el art\u00edculo 4\u00ba bis del Anexo II la Ordenanza 13041 que quedar\u00e1 redactado de la siguiente forma:
\n\u201cArt\u00edculo 4\u00ba bis: Con el cincuenta por ciento (50%) de lo producido con las ventas de tierras fiscales, se conforma un fondo especial cuya denominaci\u00f3n ser\u00e1 \u201cAcceso a tu Hogar\u201d cuyo objetivo es financiar la producci\u00f3n de suelo urbano de uso habitacional. Para tal fin se podr\u00e1 realizar la inversi\u00f3n sobre reservas fiscales municipales o propiedades transferidas por el Estado Provincial o Nacional, de las cuales se concrete como m\u00ednimo la posesi\u00f3n en favor del Municipio. Tambi\u00e9n podr\u00e1 destinarse estos fondos a la adquisici\u00f3n de nuevos terrenos, la compra y la afectaci\u00f3n a este destino deber\u00e1n hacerse previa Ordenanza que autorice el proyecto ejecutivo espec\u00edfico.\u201d<\/strong><\/p>\nArt\u00edculo 2:<\/strong> Modificase los art\u00edculos 24\u00ba y 63\u00ba y el nombre del T\u00edtulo IV del Anexo II la Ordenanza 13041 que quedar\u00e1n redactados de la siguiente forma:
\n\u201cArt\u00edculo 24\u00ba: Cumplidas por el concesionario todas las obligaciones legales y contractuales, la Municipalidad, otorgar\u00e1 el correspondiente t\u00edtulo de dominio, ajust\u00e1ndose a todas las normas vigentes.
\nLa persona propietaria no podr\u00e1 transferir el predio a terceros por el t\u00e9rmino de diez (10) a\u00f1os quedando exceptuados \u00fanicamente la transferencia ordenada por autoridad judicial en tr\u00e1mite sucesorio y aquella que se realice entre personas vivas que est\u00e9n en la l\u00ednea sucesoria; caso contrario, la transferencia dominial efectuada ser\u00e1 nula. Vencido el plazo, contado a partir de su inscripci\u00f3n en el Registro de la Propiedad Inmueble, el dominio ser\u00e1 pleno en los t\u00e9rminos del C\u00f3digo Civil. Esta prohibici\u00f3n deber\u00e1 ser incluida como cl\u00e1usula especial en el T\u00edtulo. El Registro de la Propiedad Inmueble no inscribir\u00e1 escrituras traslativas de dominio ni hijuelas que violen las disposiciones del presente.\u201d<\/strong><\/p>\n\u201cT\u00edtulo IV: Transferencia a Pueblos Originarios<\/strong>
\nArt\u00edculo 63\u00ba:Se adjudicar\u00e1, en car\u00e1cter de donaci\u00f3n y como reparaci\u00f3n hist\u00f3rica, los terrenos municipales ocupados por personas que pertenezcan a pueblos originarios. Deber\u00e1n adjuntar la certificaci\u00f3n correspondiente del Instituto del Aborigen Chaque\u00f1o (I.D.A.CH.).Se realizar\u00e1 previa mensura y subdivisi\u00f3n de corresponder, a trav\u00e9s de las \u00e1reas pertinentes del Municipio.
\nLas tierras que se adjudiquen en virtud de este art\u00edculo no podr\u00e1n ser embargadas, enajenadas, ni constituirse sobre ella garant\u00eda alguna, ya sea por acto entre vivos o disposici\u00f3n de \u00faltima voluntad, bajo pena de nulidad absoluta. El Registro de la Propiedad Inmueble no inscribir\u00e1 escrituras traslativas de dominio haciendo constar esta restricci\u00f3n.<\/strong><\/p>\nArt\u00edculo 3:<\/strong> Agr\u00e9guese como \u00faltimo p\u00e1rrafo al art\u00edculo 11 del Anexo II de la Ordenanza 13041, el siguiente:
\n\u201cArt\u00edculo 11: Determinada la procedencia de la solicitud y sancionada la Ordenanza que autorice la concesi\u00f3n en venta, el Intendente Municipal dispondr\u00e1 la concesi\u00f3n en venta, firm\u00e1ndose en todos los casos el contrato de compra-venta respectivo, de acuerdo al Anexo VI de la presente.
\nEn el contrato de compra-venta se transcribir\u00e1 la obligaci\u00f3n comprendida en el inciso d) del art\u00edculo 12 de la presente.\u201d<\/strong><\/p>\nArt\u00edculo 4:<\/strong> Agr\u00e9guese como \u00faltimo p\u00e1rrafo del art\u00edculo 12 del Anexo II de la Ordenanza 13041, el siguiente:
\n\u00abArt\u00edculo 12: Los concesionarios deber\u00e1n cumplir con las siguientes obligaciones:
