VISTO:<\/strong><\/p>\n

Los art\u00edculos 135 inciso 2) y 138 de la Carta Org\u00e1nica Municipal, el art\u00edculo 41 de la ordenanza 1719 y el art 156 de la Ley 800-H<\/p>\n

CONSIDERANDOS:<\/strong><\/p>\n

Que los reclamos recibidos en la oficina del concejal y en distintos medios de comunicaci\u00f3n, respecto a la falta de pago a las jubiladas y los jubilados de la Municipalidad de Resistencia por su desempe\u00f1o como empleados municipales;<\/p>\n

Que el atraso en hacer efectivo el cobro de una prestaci\u00f3n o de una liquidaci\u00f3n mientras el tr\u00e1mite administrativo avanza, conlleva el perjuicio econ\u00f3mico a la o las personas que esperan pacientemente; m\u00e1s a\u00fan cuando la persona no tiene ninguna posibilidad de obtener otro ingreso,<\/p>\n

Que el Municipio de Resistencia manifiesta que no existe motivo alguno por cual opere el incumplimiento para los derechos de los y las jubiladas que le son otorgados por resoluci\u00f3n firmada por el propio intendente;<\/p>\n

Que la judicializaci\u00f3n de ese incumplimiento trae aparejado un mayor costo para la Municipalidad de Resistencia, y a\u00fan m\u00e1s para los trabajadores que esperan por un ingreso que no llega y que en algunos casos sufren zozobras ante la incertidumbre y destrato que reciben,<\/p>\n

Que especialmente nos preocupa y creemos que deben tener prioridad aquellas liquidaciones que surgen de acuerdos laborales y que tienen car\u00e1cter alimentario,<\/p>\n

Que en virtud del Art\u00edculo 138 De la carta org\u00e1nica municipal el cual posibilita al Concejo a pedir informes tanto funcionarios como al Intendente de la Municipalidad de Resistencia.<\/p>\n

QUE POR TODO ELLO:<\/strong><\/p>\n

EL CONCEJO MUNICIPAL DE LA CIUDAD DE RESISTENCIA<\/strong>
\nRESUELVE:<\/strong><\/p>\n

 <\/p>\n

Solicitar al Departamento Ejecutivo Municipal informe, respecto de las bajas de los agentes para acceder a los beneficios jubilatorios en el marco de la Ley 800-H, desde 10 de diciembre del 2019 hasta la fecha:<\/p>\n

a- Cu\u00e1ntos agentes fueron dados de baja a fin de obtener los beneficios jubilatorios Ley 800-H, indicando n\u00famero y fecha de instrumento legal, as\u00ed como la fecha de cese o baja;
\nb- Cu\u00e1ntos agentes se beneficiaron por la aplicaci\u00f3n del art\u00edculo 41 de la Ordenanza 1719, indicando la forma de pago de tal beneficio y de existir deudas indicar los agentes con acreencias pendientes de cobro por tal concepto, consignando fecha de inicio del tr\u00e1mite, forma y fecha de pago;
\nc- Si existe a la fecha de recepci\u00f3n de la presente atrasos o incumplimientos en los pagos, en caso afirmativo, expresar los motivos que llevaron a la administraci\u00f3n municipal a operar el incumplimiento;
\nd- Cu\u00e1ntos agentes han sido beneficiados por aplicaci\u00f3n del Art 156 ley 800-H (Anticipo Previsional), identific\u00e1ndolos e informando la forma y si se efectivizaron y en caso contrario, detallar los incumplimientos originados en tal concepto.<\/p>\n
