{"id":593,"date":"2020-07-30T00:10:04","date_gmt":"2020-07-30T00:10:04","guid":{"rendered":"https:\/\/fabriciob.ar\/web\/?p=593"},"modified":"2021-10-07T02:42:12","modified_gmt":"2021-10-07T02:42:12","slug":"no-quieren-cumplir-la-sentencia-que-anula-el-impuestazo","status":"publish","type":"post","link":"https:\/\/fabriciob.ar\/web\/no-quieren-cumplir-la-sentencia-que-anula-el-impuestazo\/","title":{"rendered":"NO QUIEREN CUMPLIR LA SENTENCIA QUE ANULA EL \u00abIMPUESTAZO\u00bb"},"content":{"rendered":"\r\n<p><strong><em>Crisis institucional\u201d \u00bfy ahora?<\/em><\/strong><\/p>\r\n\r\n\r\n\r\n<p><!--more--><\/p>\r\n\r\n\r\n\r\n<p>Con tristeza democr\u00e1tica y una decepci\u00f3n m\u00e1s, debemos informar a las y los vecinos de Resistencia, que la Municipalidad se encuentra desobedeciendo una sentencia judicial de C\u00e1mara. Justamente la que declara la inconstitucionalidad del impuestazo, la que determina incumplimientos de requisitos formales ineludibles para la sanci\u00f3n de una ordenanza.<\/p>\r\n\r\n\r\n\r\n<p>La ordenanza impositiva y tributaria es una de las principales para la gesti\u00f3n municipal, incide en su Presupuesto para el a\u00f1o 2020, son herramientas esenciales de planificaci\u00f3n, gesti\u00f3n y control en el uso de los recursos p\u00fablicos.<\/p>\r\n\r\n\r\n\r\n<p><strong>\u201cUtilizan el sistema de justicia para ganar tiempo y continuar aplicando una norma viciada de nulidad absoluta, una ordenanza inconstitucional\u201d<\/strong><\/p>\r\n\r\n\r\n\r\n<p>La Ordenanza 13.258, conocida por el pueblo como \u201cimpuestazo\u201d ces\u00f3 en sus efectos con las sentencias dictadas en las causas \u00abBolatti Fabricio c\/ Concejo\u2026 exp: 11165\/20 y 11166\/20, medida cautelar y amparo respectivamente, fallos que se encuentran firmes, y cuyos efectos no se suspenden ante una nueva apelaci\u00f3n o recurso que pudieran diligenciar las autoridades municipales.<\/p>\r\n\r\n\r\n\r\n<p>\u201cEstamos muy preocupados ante la actitud irresponsable que se percibe, basada en desobediencia judicial, silencio o mensajes que confunden al contribuyente, dilaci\u00f3n y negaci\u00f3n a emitir correctamente las boletas de impuestos y tasas\u201d, manifest\u00f3 el concejal del Frente Chaque\u00f1o. \u201cRechazamos el recurso extraordinario interpuesto por las principales autoridades municipales, paso jur\u00eddico necesario. Entendemos que no acompa\u00f1an nuevos argumentos, elementos o propuestas superadoras que permitan percibir una voluntad dirigida a superar esta grave situaci\u00f3n institucional y de gesti\u00f3n\u201d, agreg\u00f3.<\/p>\r\n\r\n\r\n\r\n<p>\u201cEl Municipio solo quiere dilatar el cumplimiento de la Sentencia Judicial\u201d, remarc\u00f3 el edil y destac\u00f3 que el fallo dictado por el Tribunal de la C\u00e1mara Contencioso Administrativa, fue contundente, claro, muy s\u00f3lido y de fundamentos irreversibles, detallando cada una de las irregularidades y omisiones legales que se cometieron en el proceso legislativo.<\/p>\r\n\r\n\r\n\r\n<p>\u201cPor lo tanto, creemos que est\u00e1n dadas las condiciones para una nueva liquidaci\u00f3n de los impuestos y acreditar el saldo en favor de quienes pagaron dem\u00e1s. Resaltamos una vez m\u00e1s, nuestra voluntad de construir el consenso que permitan dictar una nueva norma que goce de legalidad y legitimidad p\u00fablica, de nada sirve continuar en esta situaci\u00f3n de incertidumbre\u201d, aclar\u00f3.<\/p>\r\n\r\n\r\n\r\n<p>\u201cEsta actitud es irrespetuosa hacia la comunidad de Resistencia, que tambi\u00e9n viene reclamando por distintas v\u00edas administrativas y judiciales el porcentaje desmedido o envergadura del aumento de los tributos\u201d, se\u00f1al\u00f3.<\/p>\r\n\r\n\r\n\r\n<p>Finalmente, el edil detall\u00f3 que se realiz\u00f3 la presentaci\u00f3n de un escrito -\u201cBolatti Fabricio Nelson s\/ Incidente\u2026Expte. 11240\/20- en la que se pide se haga efectivo el apercibimiento de Ley y se denuncia el incumplimiento de la sentencia. \u201cApelo a que la situaci\u00f3n se resuelva pronto y que podamos brindar garant\u00edas y seguridad a las y los vecinos, lo que se logra haciendo las cosas bien y sancionando una ordenanza que cumpla todos los pasos legales y constitucionales\u201d.<\/p>\r\n","protected":false},"excerpt":{"rendered":"<p>Crisis institucional\u201d \u00bfy ahora?<\/p>\n","protected":false},"author":3,"featured_media":594,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_joinchat":[],"footnotes":""},"categories":[27],"tags":[],"class_list":["post-593","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-comunicados-de-prensa"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
