{"id":6328,"date":"2021-06-23T20:43:23","date_gmt":"2021-06-23T20:43:23","guid":{"rendered":"https:\/\/fabriciob.ar\/web\/?p=6328"},"modified":"2021-09-23T20:49:03","modified_gmt":"2021-09-23T20:49:03","slug":"derogar-la-ordenanza-que-otorga-certificado-parcial-final-de-obras","status":"publish","type":"post","link":"https:\/\/fabriciob.ar\/web\/derogar-la-ordenanza-que-otorga-certificado-parcial-final-de-obras\/","title":{"rendered":"DEROGAR LA ORDENANZA QUE OTORGA CERTIFICADO PARCIAL FINAL DE OBRAS"},"content":{"rendered":"<p><!--more--><\/p>\n<p>&nbsp;<\/p>\n<p><strong>VISTO:<\/strong><br \/>\nLa peligrosidad de la Ordenanza 13.553 del a\u00f1o 2021;<\/p>\n<p><strong>CONSIDERANDO:<\/strong><\/p>\n<p>Que la sanci\u00f3n de la Ordenanza 13.553 suspendi\u00f3 obligaciones establecidas en el C\u00f3digo de Planeamiento Urbano y Reglamento General de Construcciones 1681;<\/p>\n<p>Que por la misma se otorga un Certificado Parcial de Final de Obra, a construcciones que tienen observaciones de lo m\u00e1s diversas que incluyen cuestiones de seguridad que podr\u00edan generar da\u00f1os irreparables en los bienes y en las personas, relacionados a la vigencia de la ordenanza 13.553;<\/p>\n<p>Que por ejemplo entre esas observaciones pueden estar las relacionados con las condiciones de seguridad para evitar incendios, tambi\u00e9n las relacionadas con las instalaciones cloacales y la cantidad de cocheras con las que debe el edificio, que si no se prev\u00e9 dentro de la parcela del edificio traen un impacto importante en el espacio p\u00fablico;<\/p>\n<p>Que en el art\u00edculo 2\u00b0 de la ordenanza que queremos derogar, pueden encontrarse autorizadas construcciones que no tengan todos los niveles terminados,<\/p>\n<p>Que el plazo establecido de vigencia de la Ordenanza 13.553 hasta diciembre del 2023, funciona m\u00e1s como una aparente legalidad fomentando el no cumplimiento de la legislaci\u00f3n vigente;<\/p>\n<p>Que en el art\u00edculo 5\u00b0 se establecen los plazos para completar las observaciones o los faltantes de la obra, tareas no ejecutadas por la empresa constructora, que deber\u00edan ser subsanadas, pudiendo pedir prorrogadas por un plazo de un a\u00f1o, sin ninguna otra exigencia m\u00e1s que la solicitud de parte;<\/p>\n<p>Que no nos parece correcto que la misma autoridad de aplicaci\u00f3n los pueda prorrogar, sin otro control, ya que son tiempos muy extensos para que una obra en construcci\u00f3n con observaciones permanezca sin inspecciones de ning\u00fan tipo, pudiendo ocasionarse perjuicios derivados de esos incumplimientos;<\/p>\n<p>Que en la pr\u00e1ctica funciona como un encubrimiento de las irregularidades y que luego tendr\u00e1 que hacerse cargo la gesti\u00f3n siguiente del estado de las construcciones en la ciudad de Resistencia;<\/p>\n<p>Que as\u00ed como est\u00e1 la legislaci\u00f3n actual, con la posibilidad de otorgar el Certificado Parcial Final de Obra, lo que hace es favorecer a un determinado sector de la construcci\u00f3n, al no ser evaluado caso por caso, obviando la complejidad o circunstancias de aquellas obras que ameriten un mayor control t\u00e9cnico espec\u00edfico, por sus dimensiones e impacto ambiental;<\/p>\n<p>Que el mayor control genera transparencia en la ejecuci\u00f3n evitando as\u00ed los reclamos a futuro de las personas adquieran esos inmuebles, que no pudieron percibir las irregularidades al momento de la adquisici\u00f3n;<\/p>\n<p>Que la Carta Org\u00e1nica del Municipio de Resistencia, en su art\u00edculo 137 otorga la facultad al Concejo Municipal para el dictado de la presente;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><strong>QUE POR TODO ELLO:<\/strong><\/p>\n<p style=\"text-align: center;\">\n<p style=\"text-align: center;\"><strong>EL CONCEJO MUNICIPAL DE LA CIUDAD DE RESISTENCIA<\/strong><br \/>\n<strong>SANCIONA CON FUERZA DE ORDENANZA:<\/strong><\/p>\n<p><strong>Art\u00edculo 1:<\/strong> Derogar la Ordenanza 13.553 del 2021 y restituir el texto vigente anterior a su sanci\u00f3n.<\/p>\n<p><strong>Art\u00edculo 2:<\/strong> De forma.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":3,"featured_media":6329,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_joinchat":[],"footnotes":""},"categories":[40],"tags":[],"class_list":["post-6328","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-proyectos-de-ordenanzas"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
