Hoy convivimos con un verdadero festival de sobreprecios en la obra p\u00fablica y en la contrataci\u00f3n de servicios, que se paga con la plata del Estado, es decir, con el esfuerzo del pueblo.<\/p>\n<p>El gobierno provincial y el municipal coordinan m\u00e1s de lo que se cree: poco en gesti\u00f3n, pero mucho en acuerdos de contrataci\u00f3n. Ambos coinciden en un esquema que les permite evadir la Licitaci\u00f3n P\u00fablica y refugiarse en la Contrataci\u00f3n Directa, el mecanismo que abre la puerta a elegir empresas a dedo y fijar precios discrecionales.<\/p>\n<p><strong>Manipulaci\u00f3n normativa<\/strong><br \/>\nLa Ley de Administraci\u00f3n Financiera establece montos que obligan a contratar bajo distintos procedimientos: Contrataci\u00f3n Directa, Concurso de Precios, Licitaci\u00f3n Privada y Licitaci\u00f3n P\u00fablica. La diferencia entre uno y otro depende del monto de la contrataci\u00f3n.<br \/>\nEl gobernador Zdero modific\u00f3 esos l\u00edmites de manera arbitraria: elev\u00f3 el piso de la Licitaci\u00f3n P\u00fablica de $135 millones a m\u00e1s de $1.000 millones, un incremento del 641% desde que asumi\u00f3. No fue la inflaci\u00f3n la causa, sino la necesidad de alejar la obligaci\u00f3n de licitar en procesos transparentes.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-9860\" src=\"https:\/\/fabriciob.ar\/web\/wp-content\/uploads\/2026\/05\/cUADRO-1.jpg\" alt=\"\" width=\"748\" height=\"131\" srcset=\"https:\/\/fabriciob.ar\/web\/wp-content\/uploads\/2026\/05\/cUADRO-1.jpg 748w, https:\/\/fabriciob.ar\/web\/wp-content\/uploads\/2026\/05\/cUADRO-1-300x53.jpg 300w\" sizes=\"(max-width: 748px) 100vw, 748px\" \/><\/p>\n<p>La gesti\u00f3n de Roy Nikisch aprovech\u00f3 esta decisi\u00f3n \u201ccomo anillo al dedo\u201d. Se escuda en la supuesta adhesi\u00f3n a la normativa provincial a trav\u00e9s de la Ordenanza 8.936, que en realidad regula otro tema y no las contrataciones. El resultado: m\u00e1s de 9 de cada 10 contrataciones se realizan por Compra Directa, el mecanismo menos transparente y m\u00e1s propicio para el sobreprecio.<\/p>\n<p><img decoding=\"async\" class=\"size-full wp-image-9861 aligncenter\" src=\"https:\/\/fabriciob.ar\/web\/wp-content\/uploads\/2026\/05\/cUADRO-2.jpg\" alt=\"\" width=\"646\" height=\"310\" srcset=\"https:\/\/fabriciob.ar\/web\/wp-content\/uploads\/2026\/05\/cUADRO-2.jpg 646w, https:\/\/fabriciob.ar\/web\/wp-content\/uploads\/2026\/05\/cUADRO-2-300x144.jpg 300w\" sizes=\"(max-width: 646px) 100vw, 646px\" \/><\/p>\n<p><strong>Vac\u00edo legal y discrecionalidad<\/strong><br \/>\nConsultas realizadas muestran que no existe una norma municipal expresa y vigente que disponga la adhesi\u00f3n integral al r\u00e9gimen provincial. El municipio deber\u00eda regirse por su Carta Org\u00e1nica y ordenanzas propias, que fijan l\u00edmites mucho m\u00e1s bajos para habilitar la Licitaci\u00f3n P\u00fablica.<\/p>\n<p>La aplicaci\u00f3n de par\u00e1metros provinciales en el \u00e1mbito local genera un vac\u00edo jur\u00eddico y una pr\u00e1ctica administrativa discrecional, incompatible con la magnitud econ\u00f3mica de las contrataciones. Se afecta as\u00ed la publicidad, la igualdad entre oferentes y la transparencia en el manejo de fondos p\u00fablicos.<\/p>\n<p>En conclusi\u00f3n, la combinaci\u00f3n de decisiones provinciales y municipales configura un esquema dise\u00f1ado para evadir la Licitaci\u00f3n P\u00fablica y consolidar la Compra Directa como regla. Esto permite elegir empresas amigas, fijar condiciones a medida y aplicar sobreprecios que terminan pag\u00e1ndose con el dinero del
